Terms and Conditions.
(Note: The term “we” herein refers to “I” in the event there is only one parent as guardian. The term “camp” refers to “Hashomer Hatzair Young Guard - Camp Shomria, Canada”. The term “child” refers to your child).
1. An application form must be completed in full through the CampBrain system by parent(s) or guardian(s), for Camp Shomria (hereinafter referred to as “camp”). Verbal applications are not permitted. Applications will be reviewed in the order in which they are received. Camp Shomria reserves the right to carefully review all camper applications and, in certain circumstances, may choose not to accept an application. A $500 deposit is due along with your application for all sessions. Applications cannot be considered until we have received your deposit. $250 from the deposit will be non-refundable, regardless of circumstances, to cover administrative costs associated with withdrawn registration. $250 from the deposit will be refundable until February 15th. Cancellation after February 15th will result in the full loss of your deposit. Registration after February 15th means that your deposit is non-refundable in full. Camp reserves the right to cancel enrollment if fees are not paid in full by April 15th. A late fee penalty of $100 may be charged in the case of overdue payments unless an alternative payment plan has been agreed upon in advance in writing. A late registration fee of $200 will apply to all registrations after April 15th and full payment will be required at the time of registration. No new registrations will be accepted after May 15th. All cancellations must be communicated in writing.
2. The financial obligations of the camp are fixed for the season and the withdrawal of a camper does not lessen operating expenses. If a camper withdraws between March 31st and May 31st, an additional $500 (plus the $500 deposit) will be forfeited to the camp. If a camper withdraws for any reason on or after June 1st, the entire camp fee will be forfeited.
Once a camper arrives at camp, no refunds will be issued in the case that your child leaves camp early or misses days of camp for any reason*. Any additional transportation provided by the camp shall be an additional charge. This policy enables us to continue keeping camp affordable, invest in our programming, site, and staff, and provide needs-based support to reduce access barriers to camp.
*The only exception to this policy is in the rare situation that a camper is sent home for medical reasons. In this circumstance, and at the discretion of the camp, a partial refund of up to 35% of the daily tuition paid for missed days may be issued at the end of the camp season.
3. Camp reserves the right to dismiss the child and send the child home at any time without notice when it is deemed to be in the best interest of either the child or camp, or for violation of any camp rule/policy, all as determined by the camp in its sole and absolute discretion. No refunds shall be given under any circumstance for dismissal or withdrawal of the child for any reason whatsoever, including being sent home for medical reasons, unless as a result of the clear negligence of the camp. If the child must be sent home for behavioural issues and the parent cannot pick up the child that day, the parent shall pay transportation charges to be determined by the camp to cover costs incurred. Camp reserves the right, at any time up to the date camp starts, to not allow attendance of the child if it is deemed in the camp’s sole discretion in the best interests of the other campers. Refusing to allow the child to come to camp could be as a result of health concerns from, for example an infectious disease, or for other medical reasons.
4. Items not permitted in camp, (for example, but not limited to, cellphones, laptops, tablets, knives, lighters, etc.) shall be confiscated. The child may be sent home for the remainder of camp, to be determined by the camp in its sole and absolute discretion. Camp cannot be held responsible for lost, damaged or stolen belongings including clothing collected for laundry. Campers should not bring valuables to camp. We permit the camp to open any mail or packages in the capacity as guardian for the child.
5. The parent(s)/guardian(s) hereby consent to the use by the camp of my child’s photo, video and/or audio recording, birthday listing and name both at camp and during the year for camp related activities, for publicity, or other purposes.
6. We consent to the camp sharing our child’s contact information with other camp families. We give our consent to the camp to retain any of our child’s camper information for use at camp to allow for the physical and emotional safety of every camper. No camper or parent shall use any camp name, or photo/video on any website or the internet without the explicit permission of camp and if so, such camper may not be permitted to attend camp.
7. If the child’s health form, fully filled out and signed, is not received by June 1st the camp may cancel the enrolment of the child without refund. If the child is accepted into camp with an incomplete medical form, the camp is not liable in any way for any medical treatment given to the child. The child’s attendance at camp and your relationship with camp, its Directors, officers, employees, medical staff and agents shall be governed by the laws of the Province of Ontario and you (the parent(s) and/or guardian(s)), and/or your heirs, executors, successors and/or assigns shall irrevocably submit to the exclusive jurisdiction of the courts of the Province of Ontario in that regard. The parent(s)/guardian(s) give permission for the child’s health information/treatment to be shared with appropriate camp staff and outside personnel as deemed necessary.
8. COVID-19 ACKNOWLEDGEMENT: Camp Shomria strongly encourages all camp participants to stay current with recommended vaccinations and boosters against COVID-19 (please note this is a change from our previous policy which required two doses). By registering for Camp Shomria programs you acknowledge and accept the inherent risk of exposure to COVID-19 and agree to adhere to any COVID-19 protocols that we may institute throughout the year, including between registration and the start of camp.
The parent/guardian acknowledges that if COVID-19 continues to spread throughout Canada, it is possible that the child may come in contact with other adults and children, and that it is possible the child could become sick with or exposed to COVID-19, whether at camp or elsewhere or that such exposure could then cause others such as a family member to be exposed. The camp will maintain proper hygiene and infection control practices at camp in consultation with the Ontario Camps Association health protocols. It is possible that the operational program of camp could change for health reasons and if so, we will advise you so that you can prepare your child. Of course, the camp cannot guarantee that the child will not become infected with or be exposed to COVID-19.
I acknowledge that camp is committed to complying with the relevant guidelines or policies of any relevant provincial and local public health authority to comply with all health-related matters including reducing transmission of COVID-19. I understand that these measures may and will not eliminate all risk of harm to the child or my family and that participation in camp comes with inherent risks including the many risks outlined above. If COVID-19 continues to spread throughout Canada and outside of Canada, it is possible that the child could be exposed to COVID-19 and that Ontario health guidelines may require the composition of the camp and cabin groups and/or sessions to change. In the event camp needs to change enrollment, such that it has to cancel or change a session, best efforts will be made to maintain the child’s enrollment by offering another session subject to availability. Changes will be made in priority based on the date of registration of the child. Camp reserves the right to change or update our policies and/or programs and add reasonable COVID fees of up to $250 per child pursuant to recommendations and/or changes to the Ontario COVID-19 public health guidelines prior to and/or during camp.
I agree to let camp know of any pre-existing health concern that could impact the child’s health at camp. One such example would be something that would make a camper more likely to be at risk due to COVID-19. I will discuss with the child the importance of following all health protocols of the camp such as not visiting other cabins, screening guidelines and protocols or prevention control methods that the camp outlines to us.
I hereby give authority and consent for any testing facility or hospital to disclose to the camp the results of any medical tests, COVID-19 testing, or other tests conducted on my child. I further give permission for camp to provide the necessary contact information and health card information to the testing facility or Lab that will be doing such testing of the child.
9. The camp shall not be held responsible and is hereby released from any liability for any sickness, accident, or injury to the child and we (the parent(s)/guardian(s)) is/are aware that there are risks inherent with activities that take place at any camp unless arising from willful neglect. These risks include, but are not limited to, bodily injury, personal injury, emotional injury and death. If the child has not been fully immunized, pursuant to Canadian and or Provincial recommendations, the camp has the right to not accept the child. As camp staff, our effort to ensure a safe and healthy environment at camp includes health promotion, of which immunization is a key component. By doing so, we align ourselves with school boards and Health Canada. As such we request that all campers and staff at camp have received all of the following immunizations: Measles, Mumps, Rubella, Pertussis, Tetanus, Diphtheria, Polio, Haemophilus influenzae type b, Meningococcal, Pneumococcal, Chicken Pox, Hepatitis B vaccines as approved by age group. (If, for whatever reason, you have elected NOT to have the child vaccinated for any of the above, we ask that you communicate this to us in writing via email by May 1st and we will decide if your child is permitted to attend camp. Entry to camp is only permitted if such vaccines have been given to the child allowing for full vaccination effectiveness to be achieved. If the child is not permitted to attend camp, we will return your deposit if notified of this by no later than May 1st and after such date the deposit shall not be returned unless the camper spot can be filled by another camper. In the unlikely event that a case of measles for example, or any other disease targeted by Ontario’s vaccination program is discovered at camp, and the child was permitted to attend camp despite not being vaccinated, children who are unvaccinated will be sent home for the recommended period of isolation (i.e. measles – 21 days) without any fee adjustment.
10. The camp is authorized to secure medical treatment for the child when appropriate, including medication, x-ray, hospitalization, anesthesia, or surgery. If for any reason the child requires such medical attention or special medication beyond that provided by camp, the parent/guardian agrees to be responsible for any expenses incurred, we therefore recommend you obtain medical insurance.
11. The parent/guardian confirms that the camp complies with Canadian/Ontario law with regard to the rules of safety, and supervision for any waterfront activities such that a minimum of bronze medallion or equivalent is provided in each swim, tripping or waterfront related activity. We confirm that on a canoe trip cellular service may not be available and medical assistance is a minimum of two hours away.
12. The parent(s)/guardian(s) signing this contract has/have the legal guardianship of the child named and act as custodial parent(s), and are in agreement and are aware the child is attending camp such that whomever executes this contract has the legal authority to be able to make the decision to send the child to camp on behalf of all parents/guardians. All parents/guardians agree to read the terms of this contract and agree that unless they contact us in writing they both agree to the terms herein. We, the parent(s)/guardian(s) agree to read the season’s Camp Family Handbook (distributed in spring) so that we are aware of all the rules, and policies of the camp and that we understand that all of the camp rules, as outlined in the handbook or otherwise apply to the child and we agree to review this handbook with the child and the applicable rules/policies. The parent(s)/guardian(s) agrees that we will contact the camp in writing if any “accommodation” is required for the child to participate fully in the program.
13. The parent(s)/guardian(s) agree to update the camp of any camp/home/school issues, (suspension, discipline) or social, emotional, or psychological issue that could affect the child or any other child, prior to camp. The parent/guardian further acknowledge that attendance and/or participation at camp involves risk and hazards incidental thereto including but not limited to, bodily injury, personal injury, emotional injury and death, all of which are assumed by us and the camp shall not be held responsible and is hereby released from any liability for any sickness, accident or injury to the child. The parent(s)/guardian(s) hereby waive, release, absolve and agree to indemnify and save harmless the camp and their respective officers, directors, employees and agents of any and all liability arising from the child’s attendance and/or participation of the camp program. The parent(s)/guardian(s) desire the child to participate in the full camp program including all trips (including canoe trips) unless we advise the camp of a restriction (medical or otherwise), in writing such that the camp confirms in writing receipt of such restriction.
14. In the event of “Force Majeure” or Act of God, meaning the occurrence of an event or circumstance that prevents the camp from fulfilling this contract, the contract is null and void. Such occurrence is something that could not be overcome by the camp and includes, war, currency and trade restrictions, act of any government authority to close camp, plague, epidemic, pandemic, natural disaster, weather event, nuclear or chemical contamination, explosion, fire, destruction of equipment, inability to obtain labour due to some specific labour boycott or government change.
